Indemnity 

You agree to indemnity, defend or hold harmless Mimoto and its Providers from and against all losses, expenses, damages and costs arising from and violation of these Terms of Use, any activity related to your account (including infringement of third parties' intellectual property rights) or which arises from negligence, omission or fraud on your part or any other person who accesses mimoto.com.au using your account service. You also agree to waive all claims you may have against Mimoto for any losses or damages you may sustain in connection with mimoto.com.au

To the fullest extent permitted at law, Mimoto is providing this site and its contents on as "as in" basis and makes no representations or warranties of any kind with respect to this site or its contents. Mimoto disclaims all such representations and warranties.

Limitation of Liability

This liability section applies only to the extent permitted by law. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quality stated on your order form, Mimoto shall, at its on option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund you the amount you paid for the goods in question PROVIDED THAT you notify Mimoto of the problem in writing to elizabeth@mimoto.com.au within 7 days of delivery of the goods.
 
Illegal acts

It is a crime to use a false name or a know invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.

Modification of Terms

Mimoto reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting of Mimoto site.
